Creomind Foundation — Terms of Service

1. Acceptance of Terms

By accessing or using any service, website, application, or system provided by Creomind Foundation ("Creomind," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, you must not use our services. These Terms form a binding agreement between you ("you," "Client," or "Family") and Creomind.

2. Nature of Our Services

Creomind designs and operates consciousness preservation systems — bespoke AI mind clones built from voice, writing, memory, and behavioral data provided by a subject ("Source") with informed, documented consent. Our services are research-grade, craft-driven, and offered to a strictly limited number of families per cohort.

Our outputs are simulations. They are designed to evoke the presence, voice, and reasoning patterns of a Source. They are not, and never will be presented as, the literal continuation, resurrection, or replacement of a person.

3. Eligibility and Consent

You must be at least 18 years old to enter an agreement with Creomind. Construction of a mind clone requires verifiable, written consent from the Source while they are of sound mind, or from a legally authorized representative when the Source is deceased and applicable law permits posthumous data use. We reserve the right to decline any engagement that fails our consent or ethics review.

4. Cohort Admission and Application

Admission to a cohort is at our sole discretion. Submitting an application does not guarantee acceptance. We may decline based on capacity, technical feasibility, ethical review, alignment of values, or any factor we deem relevant to the safe operation of our work.

5. Engagement, Fees, and Refunds

Specific deliverables, timelines, fees, and refund terms are set out in the individual engagement agreement signed by each accepted family. In the event of conflict between these Terms and a signed engagement agreement, the engagement agreement controls for the matters it addresses.

6. Acceptable Use

You agree not to use any Creomind system or output to:

• impersonate the Source for fraud, financial gain, legal manipulation, or coercion of third parties;
• generate sexual, defamatory, or harassing content involving the Source or any third party;
• fabricate statements presented as the Source's real, present-day testimony;
• train, fine-tune, or distill any other AI model without our written authorization;
• circumvent safety, identity, or memory boundaries we have configured.

7. Intellectual Property

Source data — voice, writing, memories, likeness — remains owned by the Source or their estate. Creomind retains ownership of the underlying methodology, model architectures, training pipelines, and tooling used to construct mind clones. You receive a personal, non-transferable license to use the delivered clone within the boundaries of your engagement agreement.

8. Privacy and Data Handling

Our handling of personal data is governed by our Privacy Policy and Data Charter, both of which are incorporated into these Terms by reference.

9. Disclaimers

Our services are provided on an "as is" and "as available" basis. We make no warranty that a mind clone will perfectly reproduce the Source, satisfy any therapeutic purpose, or be free from error or unexpected behavior. Mind clones are not a substitute for medical, psychological, legal, or financial advice.

10. Limitation of Liability

To the maximum extent permitted by law, Creomind's total aggregate liability arising out of or relating to these Terms or our services shall not exceed the fees paid by you to Creomind in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

11. Termination

We may suspend or terminate access to our services at any time if you breach these Terms, violate our Acceptable Use policy, withdraw or invalidate consent, or jeopardize the safety, dignity, or privacy of a Source or third party. Upon termination, sections 6 through 13 survive.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to active clients in writing. Continued use of our services after an update constitutes acceptance of the revised Terms.
